Terms of Sales
These General Conditions of Sale are concluded between on the one hand, the company SARL YORUBA, holder of the domain name vdevinster.fr, SARL with capital of 6000 euros registered with the Toulouse RCS under number 480 252 931 – APE 4771Z – SIRET 480 252 931 000 39 – Intracommunity identification number / VAT Identification FR 54480252931, whose head office is established in France, at 3, Rue de la madeleine 64210 BIDART, France publisher of the site www.vdevinster.fr , and hereinafter referred to as “V DE VINSTER”
On the other hand, any natural or legal person visiting or making a purchase on the Site www.vdevinster.fr , and hereinafter referred to as “the Customer”
The following definitions apply in these general conditions of sale according to the meaning indicated below (whether used in the singular or plural).
· “General Conditions of Sale”: designate this document, i.e. the terms and conditions applying in the relations between V DE VINSTER and the Customer.
· “Order”: designates the Customer’s purchase order for one or more Product(s) placed through use of the Website.
· “Site”: designates the website accessible at the address www.vdevinster.fr published by V DE VINSTER
· “Product”: designates a product offered for sale on the Website
· “Customer”: designates a natural or legal person, consumer and/or professional, who uses the Website and acquires one or more Product(s), for their personal needs, through the website, having previously adhered to the General Conditions of Sales.
· “Recipient” means the natural person designated by the customer to receive the order.
These conditions express the entirety of the obligations of the parties. In this sense, the Customer accepts in advance and without reservation all of the provisions provided for in these general conditions. In the event of disagreement with the terms and conditions of the General Conditions of Sale, the Customer must not use the Website.
No general or specific conditions appearing in the documents sent or delivered by the Customer may be incorporated into these terms, as long as these documents are incompatible with these general conditions.
V DE VINSTER reserves the right to adapt or modify these General Conditions of Sale at any time and without notice, the adaptations or modifications then being applicable to all orders subsequent to these adaptations or modifications.
In the event of modification, the General Conditions of Sale applicable to the Customer's order are those which were online, and which the Customer accepted on the day of placing his Order.
These General Conditions of Sale aim to define:
· Contractual relations between V DE VINSTER and the Client
· The conditions applicable to any purchase of products made on the Site www.vdevinster.fr whether the Customer is of French or foreign nationality, or whether he is a professional or consumer.
Any use of the Website and any placing of an Order for one or more Product(s) through the Website implies pure and simple acceptance of all of the General Conditions of Sale.
Only persons legally capable of entering into contracts concerning the Products offered for sale on the Site may place an Order on the Website. When placing the order, the Customer guarantees having full legal capacity to adhere to the General Conditions of Sale, place an Order and conclude a sale.
These conditions apply throughout the duration of the online posting of the products and services offered by the company SARL YORUBA, holder of the domain name www.vdevinster.fr
6- Acceptance and opposition to the general conditions of sale
6.1. Accessibility of general conditions of sale
Any Internet user can read the general conditions of sale on the Site www.vdevinster.fr by clicking on the hyperlink at the bottom of each page of the Site. The general conditions of sale may be subject to modification, the applicable conditions are those in force on the Site on the date the order is placed.
6.2. Legal capacity of the Client
A Customer, under the general conditions of sale, is any legal entity or natural person, aged at least 18 years or having the authorization of the authorized person on the date of validation of their order. The Customer is a consumer or professional residing in France or abroad. By paying for their order, the Customer acknowledges having full legal capacity to commit to the general conditions of sale.
6.3. Acceptance of the general conditions of sale
The Customer acknowledges having read the general conditions of sale and expressly declares to accept them once he has confirmed his order on the Site. Concerning orders which are not placed online on the Site (email, tel...) the Customer acknowledges having read and expressly declares to accept the general conditions of sale as soon as he receives and does not contest his order confirmation email . By accepting the general conditions of sale, the Customer accepts without reservation all of the stipulations provided for in these conditions, to the exclusion of all others. The general conditions of sale are those in force on the Site on the date the order is validated by the Customer. The general conditions of sale are valid for the duration necessary for the supply of the goods and services purchased, until their guarantees expire.
7- Product characteristics and prices
7.1. Consultation of the characteristics of products and services
V DE VINSTER presents on its Site the products and their detailed descriptions allowing the Customer to know, before taking the final order, their essential characteristics. The photographs of the products presented on the Site are as faithful as possible but cannot ensure perfect similarity with the products offered, particularly with regard to the colors.
7.2. Availability of products and validity of the offer
The product offers as well as the prices appearing on the Site are valid for the current day. It is also specified that the simple fact of adding a product to the basket does not constitute validation of the order. In other words, the product may become unavailable between the time of adding it to the basket and validation of the order by the Customer. In the event that the unavailability of the product or service is noted after validation of payment, V DE VINSTER undertakes to cancel the order and fully reimburse the price paid by the Customer. In this case the reimbursement will be made without delay and at the latest within fourteen (14) days of payment of the sums paid by the Customer.
The prices of the products and services presented on the Site are indicated in Euro, all taxes included (TTC). They are applicable during the validation of the order by the Customer and do not include the contribution to transport costs, invoiced additionally and indicated on the “Delivery and returns” page of the basket before final validation of the order. Prices inclusive of all taxes include VAT (Value Added Tax) for products delivered within the European Union. Items subject to VAT are subject to French VAT. Any change in the legal French VAT rates will be reflected in the price of the products and services presented on the Site, on the date stipulated by the relevant implementing decree.
All prices indicated are inclusive of VAT. The total amount of an order is made up of the price of the items and the delivery costs. You can use the following payment methods: VISA, MASTERCARD and Paypal. If payment is refused by the authorization center, we will not be able to ship the order.
9- Order confirmation
You will receive a confirmation email as soon as we receive your order. Please have the references in this email ready for all correspondence. If you do not receive this confirmation email, contact email@example.com
10- Right of withdrawal
In accordance with article L121-20 of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of the products to exercise his right of withdrawal, without having to justify reasons, nor to pay penalties with the exception of return costs where applicable.
The period of fourteen (14) days runs from receipt of the products: when the period of fourteen (14) days expires on a Saturday, Sunday or public holiday, it is extended until the first following working day. V DE VINSTER recommends that the Customer who wishes to exercise his right of withdrawal informs Customer Service by email at firstname.lastname@example.org
11.1 Delivery costs
The delivery costs dedicated to our online sales site have been established according to the current rates of the Post Office.
11.2 Delivery times
For any order placed on the site, we undertake to prepare your orders within a maximum of 48 hours (excluding weekends and public holidays) and up to 3 days maximum, subject to product availability. If one or more items are no longer available without this being indicated in the product sheet, the Customer will be notified by email or telephone and V DE VINSTER will reimburse these items by crediting the card used to pay for the order. . We use the services of La Poste through Coliship or Colissimo. Orders shipped to France are generally delivered within 3 business days after you receive the confirmation email. V DE VINSTER cannot be held responsible for additional delays. Delivery times to foreign countries depend on your local postal services. V DE VINSTER cannot be held responsible for inappropriate behavior on the part of postal services.
Any order placed on the V DE VINSTER online sales site can only be sent to the destinations offered. We undertake to deliver the product(s) ordered to the delivery address that you have indicated to us. Please check for accuracy. Any reshipment due to incorrect address will be at your expense. We do our best to deliver to you as quickly as possible, however we are not responsible for Colissimo service delays.
12- Product return conditions
The Customer has a legal period of fourteen (14) days from the day of receipt of his order to notify V DE VINSTER of his intention to return the product to us and the reason for this return.
The return of the product(s) is made in their original packaging, intact, accompanied by all possible accessories, in perfect condition for resale, with the indication of the order number to which the products relate. The product must be returned in packaging provided for this purpose, not allowing identification of the product (postal parcel, bubble envelope, kraft paper, etc.). Any product damaged, incomplete, missing or whose original packaging has been damaged will not be refunded or exchanged and will be returned to the Customer. Concerning returns from abroad, the costs are the responsibility of the customer.
The world of fashion, on a global scale, has a colossal environmental impact. From product design, to the choice and recycling of packaging, including transport, V de Vinster tries as much as possible to reduce this impact and is part of an ecological and responsible approach.
It therefore seems important to us to limit the movement of our products. As such, return costs are not offered (except in exceptional cases).

In the event of exercising the right of withdrawal, V DE VINSTER is required to reimburse the Customer for the sums he has paid, without penalty, with the exception of shipping costs. Reimbursement is due immediately and no later than fourteen (14) days following the date of receipt of the returned products. If the return of the product(s) purchased is due to an error on the part of V DE VINSTER, the shipping and return costs will then be fully reimbursed to the Customer.
Beyond this withdrawal period, if you wish to cancel your order you must contact email@example.com. If your order has been shipped, we will ask you to return the products to us following the instructions provided by email.
15- Modification of your order
If you wish to make changes to your order, modify the delivery address or add products, do not hesitate to contact us by email at firstname.lastname@example.org
16.1. Warranty linked to transport
Colissimo is a very reliable service. However, as with any shipment, there may be a delay in delivery or the product may be lost. In the event of a delay in delivery compared to the date that we indicated to you in the shipping email, we ask you to notify us of this delay by sending us an email. We will then contact the Post Office to start an investigation. A Post Office investigation can last up to 21 days from the date the investigation begins. If during this period, the product is found, it will be redirected immediately to your home (the majority of cases). If, on the other hand, the product is not found at the end of the 21-day investigation period, the Post Office considers the package as lost. Only then can we send you a replacement product, at our expense. If the product(s) ordered were no longer available at that time, we would reimburse you for the amount of the products affected by the carrier's loss. If the product(s) were still available, but had changed sales price on the site, we would apply the new sales prices, either by reimbursing you for the difference, or by requesting additional payment regarding this price difference. We decline all responsibility for the extension of delivery times caused by the carrier, particularly in the event of loss of products or strikes. The exchange or refund of items will only be effective after the end of the postal services investigation.
16.2. Legal guarantee of conformity
In accordance with Article 211-1 et seq. of the Consumer Code, V DE VINSTER undertakes to deliver a product conforming to the order validated by the Customer and is responsible for any lack of conformity existing upon delivery. V DE VINSTER recommends that the Customer who wishes to exercise his warranty right informs Customer Service as soon as he becomes aware of it by email at email@example.com or by telephone at 06 09 04 07 51. This complaint must be motivated and accompanied by proof of the damage suffered (photos, etc.) In the event of a lack of conformity, the Customer may request, excluding any other compensation or damages: either the replacement of the product, or reimbursement of the product including transport costs .
The legal guarantee of conformity only applies to the essential characteristics of the products. The photographs of the products presented on the Site are as faithful as possible but cannot ensure perfect similarity with the products offered, particularly with regard to the colors.
16.3. The legal guarantee for defects or hidden defects
In accordance with article 1641 et seq. of the civil code, the Customer also benefits from the legal guarantee against hidden defects on the products sold on the Site www.vdevinster.fr. The implementation of the legal guarantee of conformity does not prevent action to guarantee hidden defects. Four (4) conditions must be met for the Customer to benefit from this guarantee:
· The defect or defect affecting the purchased product is serious
· The defect or defect must be hidden;
· The defect or defect existed before the purchase even if it appeared subsequently;
· It must not be the consequence of improper use of the product.
Finally, to benefit from the guarantee, the Customer must act as quickly as possible, a maximum of two (2) years from the day on which the defect or defect was discovered. If the four (4) conditions are met, the Customer may request, excluding any other compensation or damages: either the replacement of the product or reimbursement of the product including transport costs.
16.4. Implementation of guarantees
V DE VINSTER undertakes to reimburse or exchange defective products that are damaged or damaged or do not correspond to the customer's order.
16.5. Customer Complaint

17- Applicable law
The General Conditions of Sale are subject to French law. In the event of disputes, the Customer may make complaints to V DE VINSTER Customer Service by email at email@example.com or by telephone at 06 09 04 07 51 in order to seek an amicable solution. In the absence of an amicable agreement between the Parties, the dispute will be submitted to the French courts, which have sole jurisdiction in this matter.
